"Economic Law Forum under the Context of Double Cycle" was Successfully Held

From December 6 to 7, 2020, the Economic Law Institute of Civil, Commercial and Economics Law School (CCELS), China University of Political Science and Law (CUPL) successfully held an international seminar themed "Economic Law Forum under the Context of Double Cycle". More than 20 experts and scholars were invited to discuss how to better improve China's market economy system under the context of double cycle. The conference consisted of four panels: "External Circulation and International Investment", "External Circulation and Foreign Investment Law", "External Circulation and Cross-border Investment Protection" and "Internal Circulation and the Rule of Law of China's Market Economy". Scholars from all over the world have carried out wonderful discussions on the development of domestic and international market and legal environment. Associate Professor Zhang Qinyu, Director of Economic Law Institute, Civil, Commercial and Economics Law School, China University of Political Science and Law, hosted the opening ceremony and Professor Liu Jifeng, Vice Dean of CCELS, CUPL, delivered an opening speech.




The first panel "External Circulation and International Investment" hosted by Associate Professor Zhao Huimiao of Beijing University of Chemical Technology. Professor Wu Yanni of Shenzhen Academy of Social Sciences, Professor Casey Watters of Bond University and Mr. David Monyae, Director of the Center for African-China Studies, the University of Johannesburg delivered a speech respectively.


Professor Wu Yanni presented her research on financial innovation and financial supervision of Guangdong, Hong Kong and Macao Great Bay Area, focusing on the current shortcomings of China's supervision system, and put forward corresponding solutions through comparative study.


Professor Casey Watters mainly introduced the disclosure requirements in insolvency proceedings of Singapore and Hong Kong, and suggested that China should further study the relevant provisions on disclosure in the British insolvency legal system.


Director David Monyae presented the foreign investment law of Benin, South Africa and the current situation of international cooperation in infrastructure, and stressed that the international community should work together to face challenges and opportunities.


The second panel "External Circulation and Foreign Investment Law", was hosted by Ms. Li Ming, Director of Red Cross International College, Suzhou University. Associate Professor Zhang Qinyu of CCELS, Alpha Mohammed Jalloh, Director of the Center for Chinese African, Guglielmo Marconi University (Sierra Leone), faculty of Law School, Zhongnan University of Economics and Law, Ivan Cardillo, Visiting Professor of Law School, University of Trento and Moumouni Guillaume, Professor of Department of Political Science, School of Law and Politics, University of Abomey Calavi delivered a speech respectively.


Associate Professor Zhang Qinyu analyzed the legislative purpose and structure of Foreign Investment Law through the legislative process of Foreign Investment Law of China and the comparison of the new and the old ones.


Director Alpha Mohammed Jalloh put forward his views on the foreign investment law of Sierra Leone and the investment law of China, and also expressed his high recognition of China's important role in the infrastructure construction of South Africa.


Professor Ivan Cardillo analyzed the foreign investment law of China and the European Union, and put forward specific suggestions on how to apply the foreign investment law to solve the problems existing in the Italian market.



Professor Moumouni Guillaume presented his understanding of China's dual cycle development strategy from a Benin perspective, analyzed Benin’s foreign investment law and China’s investment law, and emphasized the importance of international cooperation.


Wang Yanchao, Master of School of Transnational Law, Peking University and Liu Yingda, Master of School of Grammar, Beijing University of Chemical Technology respectively reviewed and summarized the conference in detail.


On December 7, the second day, panel 3 and panel 4 were conducted.


The third panel "External Circulation and Cross-border Investment Protection" was hosted by Associate Professor Zhang Qinyu. Associate Professor Zhao Huimiao, Associate Professor Cai Wei of Sun Yat-sen University, Assistant Professor Zuo Changwu of Jinan University, Liu Ziyu, Ph.D. candidate of University of Hong Kong and Assistant Professor Yang Guodong of Southwest University of Political Science and Law delivered a speech respectively.


Associate Professor Zhao Huimiao pointed out the problems that China's corporate reorganization faced by studying on the change of the role of the government in the reorganization of listed companies in recent years and affirmed the efforts made by our country to improve the independence and efficiency of the reorganization of listed companies.


By analyzing how to apply articles 19, 20 and 21 of the Hague Convention on Choice of Court Agreement in China, Associate Professor Cai Wei expressed his views on China's reservation path to the Hague Convention on the Choice of Court Agreement.


In view of the global common problem of inappropriate exit of the company, Zuo Changwu gave some suggestions on how to remedy Chinese corporate facing the ineffective and inappropriate exit of relief against oppressionon the basis of comparative analysis.


Under the research on the prospects and challenges of Sino-US investment laws and practices, Dr. Liu Ziyu presented the key points to further deepen Sino-US trade cooperation.


Dr. Yang Guodong detailed the EU foreign investment mechanism from the legislative background of the EU foreign investment mechanism, the overview of the articles and the impact on Chinese enterprises.


The fourth panel is youth forum. Four students from CUPL made a discussion on the topic themed "Internal Circulation and the Rule of Law of China's Market Economy". Associate Professor Zhang Qinyu hosted this panel, and Dr. Ma Xuerong and three postgraduates of CUPL, Yuan Min, Chen Guang and Yang Mao, delivered a speech respectively.

For lacking research on the system of protecting the interests of financial creditors in China's financial market at present, Dr. Ma Xuerong detailed how to improve the objection right system of financial creditors in the capital budget.


From the perspective of supervision on securities fraud, Yuan Min demonstrated the improvement of securities investor protection system.


Chen Guang started from the defects of the information disclosure in the open solicitation of voting rights in China, such as the lack of special legislation, and put forward views on how to improve the information disclosure mechanism in the open solicitation of voting rights.


Yang Mao introduced the reasons why it is difficult for commercial subjects to withdraw and how to improve the market withdrawal system of commercial subjects.


Zhao Mingyang and Yang Jingyi, postgraduates from CUPL, summarized and reviewed the discussion of unit 3 and unit 4 respectively, and expressed thanks to the scholars and students for their sharing.


At the closing ceremony, Associate Professor Zhang Qinyu made a concluding remark. He expressed his sincere thanks to scholars from all over the world for their research and speeches, affirmed the significance of the discussion and research on various topics for domestic and international economic development, and expressed his earnest expectation for the future offline gathering of scholars from various countries.
