CCELS Held an Academic Lecture on "Law Application Techniques - Taking German Tort Liability Law as an Example"

On the afternoon of November 19, 2020, the academic lecture on "Law Application Techniques - Taking German Tort Liability Act As An Example" was successfully held at the Haidian campus.

The speaker of this lecture was Professor Marco Haase, Director of the Sino-German Legal Cooperation Program of the German Agency for International Cooperation (GIZ). The lecture was chaired by Professor Liu Jia'an, Director of Civil Law Institute of Civil, Commercial and Economic Law School, reviewed by Associate Professor Wu Xiangxiang and Associate Professor Shen Haien. Associate Professor Ge Pingliang worked as the translator as the lecture was given in German.

In the lecture, Professor Marco Haase introduced the method of law application - the method of legal subsumption, and explained a case of tort liability by using the above approach and at the same time, analyzed provisions in the German Civil Code, including the liability of tort damage compensation in article 823, a paralegal’s liability on the damage compensation in article 831, and the debtor's liability of compensation for infringement in Article 280, the debtor's liability based on the relationship between debts in article 241 and the debtor's fault in article 276.


In the interactive questioning session after the speech, Professor Marco Haase patiently answered the questions raised by the students on the law application one by one, which deepened the students' understanding of the methodology of law application.
